Agreement to Terms

These Terms of Service (“Terms”) govern your use of www.digitalmiles.in (“Our Site”) and any services, proposals, or engagements provided by Digital Miles, a proprietorship business registered in India under business registration number 08BAOPP4769G1Z1, whose registered address is 5119, Block 30, Rangoli Garden, Vaishali Nagar, Jaipur – 302034 (“We”, “Us”, “Our”, or “Digital Miles”).

By accessing Our Site, submitting an enquiry, booking an appointment, or engaging Us for any service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use Our Site or Our services.

Our Services

Digital Miles provides digital marketing and branding services, including but not limited to website and app development, e-commerce development, branding and graphic design, performance marketing, search engine optimisation, social media management, WhatsApp API and chatbot integration, CRM and marketing automation, and web and email hosting.

The specific scope, deliverables, timelines, and fees for any engagement will be confirmed separately in a proposal, quotation, or service agreement between Digital Miles and the client. In the event of any conflict between these Terms and a signed service agreement, the service agreement will prevail for that engagement.

Use of Our Site

You agree to use Our Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, Our Site by any third party.

You must not misuse Our Site by knowingly introducing viruses, trojans, worms, or other material that is malicious or technologically harmful, or by attempting to gain unauthorised access to Our Site, the server on which it is stored, or any server, computer, or database connected to it.

Enquiries, Bookings and Forms

When you submit a contact form, an appointment booking, or a job application through Our Site, you confirm that the information you provide is accurate and that you have the right to provide it. Submissions are sent by email and are used solely to respond to your enquiry, schedule the requested appointment, or process your application.

We aim to respond to enquiries within one business day, but We do not guarantee a specific response time, and submitting a form does not, by itself, create a binding service engagement.

Intellectual Property

Unless otherwise stated, Digital Miles owns the intellectual property rights in Our Site and in all content published on it, including text, graphics, logos, and design, which are protected by applicable copyright and trademark laws.

Deliverables created for a client under a paid engagement (such as a website, brand identity, or marketing creative) are governed by the intellectual property terms agreed in that engagement's proposal or service agreement, and ownership typically transfers to the client upon full payment unless stated otherwise in writing.

You may not reproduce, republish, or redistribute content from Our Site for commercial purposes without Our prior written consent.

Client Content and Confidentiality

Where a client shares brand assets, credentials, or business information with Us to deliver a service, We will treat that information as confidential and use it only for the purpose of delivering the agreed service, in line with Our Privacy & Cookie Policy.

You are responsible for ensuring you have the necessary rights and permissions for any content, images, or materials you provide to Us for use in your project.

Payments

Fees for services are as set out in the relevant proposal, quotation, or invoice. Unless otherwise agreed in writing, invoices are payable within the timeframe stated on the invoice.

We reserve the right to pause or withhold deliverables on an active engagement if payment is significantly overdue, after reasonable prior notice to the client.

Third-Party Links and Services

Our Site may contain links to third-party websites or make use of third-party services (such as form-submission or scheduling tools). We have no control over, and accept no responsibility for, the content, privacy practices, or availability of any linked third-party site or service.

Limitation of Liability

Digital Miles will perform its services with reasonable skill and care, but to the fullest extent permitted by law, We are not liable for any indirect, incidental, or consequential loss arising from your use of Our Site or Our services, including loss of business, revenue, or data.

Nothing in these Terms excludes or limits Our liability for fraud, or for any other liability that cannot be excluded or limited under applicable law.

Indemnity

You agree to indemnify and hold Digital Miles harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Termination

We may suspend or restrict your access to Our Site at any time, without notice, if We reasonably believe you have breached these Terms. Termination of an active service engagement is governed by the terms of the relevant service agreement.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or Our services will be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan.
